滥用职权行为与受贿行为并存时应如何定性处罚/顾园园

一、案情简介
季某,系某市中级人民法院执行法官。2006年8月,东辰集团通过建设银行分行贷款3000万元给华皖集团。贷款到期后,华皖集团无资金偿还借款,经中级法院民事调解书确认,华皖集团欠东辰集团贷款本金3000万元及利息226.8万元,华皖集团在调解生效后3日内给付东辰集团,珠绒公司承担连带清偿责任。季某为东辰集团申请执行珠绒公司和华皖集团借款合同纠纷案件的执行承办法官。
在该案的执行过程中,季某多次接受华皖集团代理人周某的吃请及现金4000元并以购房的名义向其索要“借款”10万元。之后季某积极配合周某和东辰集团的要求,加快了案件执行速度,不但在查封房产时,未到现场实地查看被查封房产的实际状况,而且在明知周某和东辰集团违反相关评估和拍卖程序,违规操作的情况下予以默许,将案件移送中院综合科继续执行,致使珠绒公司13处具有升值潜力的房产流拍从而直接抵付给东辰集团,造成华皖集团、珠绒公司损失1100万余元。
二、分歧意见
第一种意见认为,季某的行为仅构成受贿罪,且受贿数额仅为4000元。理由是:(1)申请执行人东辰集团和被执行人华皖集团协商决定评估机构是双方的权利,且案件进入拍卖程序后即已转入中院执行局综合科,与季某的意志无关。此外,加快案件的执行速度只是为了积极履行执行法官的职权,季某客观上并不能为周某谋取执行方面的便利,因此季某的行为不构成滥用职权罪。(2)客观上难以认定季某向周某所借的10万借款具有受贿性质。关于该案中10万元款项属于借款还是受贿,应当根据《全国法院审理经济犯罪案件工作座谈会纪要》的7项标准来对照分析。季某借款有明确的事由,有归还的能力,周某并未要求季某利用职务上的便利为其谋取利益。综上,应当以受贿罪追究季某的刑事责任,且受贿数额仅为4000元。
第二种意见认为,季某的行为同时构成滥用职权罪和受贿罪,且受贿数额为104000元,应当两罪并罚。理由是:(1)季某身为法院执行局的工作人员,在办理该借款合同纠纷案件期间,违反规定处理公务,造成珠绒公司经济损失1100余万元,符合滥用职权罪的构成要件。(2)在执行过程中,非法收受周某财物并为其谋取诸如违反拍卖的程序加快案件执行速度等执行案件方面的便利,故构成受贿罪。两罪同时成立时,应当在总和刑期以下,两刑中最高刑以上,根据案情决定执行的刑期。
第三种意见认为,季某的行为同时构成执行判决、裁定滥用职权罪和受贿罪,且受贿数额为104000元,应当按照受贿罪追究季某的刑事责任。理由是:(1)季某身为人民法院的司法工作人员,在执行该贷款合同纠纷案件中,在明知周某安排东辰集团与华皖集团、珠绒公司共同选择评估机构、拍卖机构,违规运以便作通过低价评估、拍卖等程序将标的物流拍的情况下,而滥用职权,将案件移交进入评估、拍卖程序,并且违反规定送达优先购买权人于拍卖日到场的通知书,客观上为周武忠违规运作创造条件,符合执行判决、裁定滥用职权罪。(2)季某以买房借款为名收受周某10万元,既没有书写借款凭据亦未约定还款时间,且周某在供述中也明确表示,该10万元是送的,而非借的。因此季某的受贿数额为104000元。(3)在将10万元认定为受贿数额的情形下,应当适用刑法第三百九十九条第四款的规定择一重罪处罚,即应以受贿罪追究季某的刑事责任。
三、评析意见
其一,本案以执行判决、裁定滥用职权罪定罪更为恰当。滥用职权罪的主体构成要素为国家机关工作人员,执行判决、裁定滥用职权罪的主体构成要素特定为司法工作人员,另季某在执行裁定的时候,严重不负责任,不履行法定执行职责,在明知评估程序系违规运作的情形下而将案件交送拍卖程序,这种放任的不作为使得华皖集团与珠绒公司遭受了巨额财产损失。即本案中季某的身份与犯罪行为同时符合滥用职权罪和执行判决、裁定滥用职权罪两个罪名,按照法理,一个行为同时符合同一法律的普通条款与特别条款规定的犯罪构成时,应当适用特别法条优于普通法条的原则,这也是由两者的关系决定的。普通条款是在一般范围内普遍适用的刑法,而特别条款是在特定范围内适用的刑法,就本案而言,特别条款的效力及于具有特定身份的人,只有这样,特别条款才会发挥其应有的意义。
其二,季某的受贿数额为104000元。该案中,季某主观借款动机无法证明,其既没有书写借款凭据亦未约定还款时间,知道后来得知周某被纪委调查,怕此事暴露才将此款还给周某,季某所借款项确实是为购买房屋所用也只能证明季某收受该10万元的用途,而不能达到该10万元系借款的目的。而该案的行贿人周某也在供述中也明确表示,该10万元是送的,而非借的,行贿人的供述与其他证据形成完整证据链的情形下,应当认定该笔款项的贿赂性质。2007年下半年,最高人民法院和最高人民检察院专门出台了司法解释,对10种市场经济条件下的新类型受贿刑事案件法律适用问题提供具体意见,其中就包括借款形式的受贿情形。综上,按照证据链的证明以及司法解释的相关规定,均应认定季某所借10万元款项为受贿款项。
其三,在以上分析成立的前提下,应当以受贿罪追究季某的刑事责任。我国刑法明确规定了收受贿赂又犯执行判决、裁定滥用职权罪的,依照处罚较重的规定定罪处罚。在刑法理论上,这是典型的处罚的一罪,对于该种犯罪,应按行为所触犯的罪名中的一个重罪论处,而不以数罪论处。在行为所触犯的两个罪名的法定刑相同的情况下,不是按所谓目的行为定罪量刑,而是按照事实情节较重的犯罪论处,本案中刑法第三百九十九条第四款的规定即是对这一处理原则的肯定。

第一条 为加强对基本医疗保险基金支出的管理,保证职工和退休人员的基本医疗,根据《北京市基本医疗保险规定》(2001年2月20日北京市人民政府第68号令),制定本办法。
第二条 参加本市基本医疗保险的职工和退休人员(以下简称参保人员)、定点医疗机构、定点零售药店、社会保险事务经办机构之间的基本医疗保险费用结算适用本办法。
第三条 市劳动和社会保障局主管全市基本医疗保险费用结算管理工作;区、县劳动和社会保障局负责本辖区内基本医疗保险费用结算管理工作。
市医疗保险事务经办机构负责本市基本医疗保险审核结算工作的业务指导和监督检查;区、县医疗保险事务经办机构负责本辖区内参保人员基本医疗保险费用的审核、结算。市和区、县社会保险基金管理机构负责参保人员基本医疗保险费用的支付。
第四条 参保人员符合本市基本医疗保险定点医疗管理规定,以及基本医疗保险药品目录、诊疗项目目录、医疗服务设施范围和支付标准的医疗费用,按本办法以及其他有关规定进行结算。
第五条 基本医疗保险费用结算包括以下范围:
(一)由基本医疗保险个人账户支付的门诊、急诊医疗费用;到定点零售药店购药的费用;基本医疗保险统筹基金起付标准以下的医疗费用;超过基本医疗保险统筹基金起付标准,按比例应由个人支付的医疗费用。
(二)由基本医疗保险统筹基金支付的住院治疗的医疗费用;急诊抢救留观并收入住院治疗的,其住院前留观7日内的医疗费用;恶性肿瘤放射治疗和化学治疗、肾透析、肾移植后服抗排异药的门诊医疗费用。
(三)职工因公外出、探亲期间在外埠县级以上(含县级)、易地安置的退休人员在当地乡级以上(含乡级)的基本医疗保险定点机构就医,符合基本医疗保险规定的医疗费用。
第六条 基本医疗保险费用按以下方式结算:
(一)参保人员门诊、急诊和住院医疗费用以服务项目结算为主要方式结算;
(二)部分病种的医疗费用按医疗机构的不同等级实行按病种结算;
(三)门诊肾透析、肾移植后服抗排异药的医疗费用实行定额结算。
第七条 参保人员到本人的定点医疗机构门诊、急诊或者到定点零售药店购药,按规定应由基本医疗保险个人账户支付的医疗费用,参保人员凭《北京市民卡》与定点医疗机构或者定点零售药店直接结算,由市和区、县社会保险基金管理机构拨付给定点医疗机构或者定点零售药店。
不属于基本医疗保险个人账户支付范围的医疗费用或者个人账户资金不足支付时,由参保人员现金结算。
第八条 参保人员在定点医疗机构住院的医疗费用中由个人支付的部分,与定点医疗机构直接结算。
参保人员在办理住院手续时,按照基本医疗保险规定应由个人支付的比例,先交纳一定数额的预交金,由定点医疗机构开具预交收据,出院时进行结算。
第九条 参保人员在定点医疗机构住院的医疗费用以及恶性肿瘤放射治疗和化学治疗、肾透析和肾移植后服抗排异药的门诊医疗费用,应由基本医疗保险统筹基金支付的部分,由医疗保险事务经办机构与定点医疗机构结算。
第十条 由基本医疗保险统筹基金支付的医疗费用,在基本医疗保险制度实施初期,市和区、县医疗保险事务经办机构根据基本医疗保险基金收缴情况及不同类别、等级医院的工作量,可以给予定点医疗机构一定数额的预付金。
第十一条 参保人员住院治疗不超过90天,每次住院为一个结算期,按实际住院天数结算医疗费用;超过90天的,以90天为一个结算期,90天以后为另一个结算期。
参保人员患精神病住院治疗不超过180天,每次住院为一个结算期,按实际住院天数结算医疗费用;超过180天的,以180天为一个结算期,180天以后为另一个结算期。
第十二条 参保人员患恶性肿瘤门诊放射治疗和化学治疗的医疗费用每90天为一个结算期,90天以后为另一个结算期。
参保人员门诊肾透析、肾移植后服抗排异药的医疗费用,每180天为一个结算期,180天以后为另一个结算期。
第十三条 参保人员跨年度连续住院的医疗费用,医疗保险事务经办机构与定点医疗机构对其当年12月31日以前(含31日)发生的住院医疗费用和自下一年1月1日起发生的住院医疗费用分别进行清结。
参保人员跨年度连续住院的医疗费用,每90天为一个结算期。
第十四条 参保人员在定点医疗机构住院的医疗费用,应由基本医疗保险统筹基金支付的,由定点医疗机构填写《北京市医疗保险住院费用审核结算凭证》每月1日至20日内向参保人员参保的市和区、县医疗保险事务经办机构申请审核、结算。
第十五条 参保人员经市和区、县医疗保险事务经办机构批准进行恶性肿瘤放射治疗和化学治疗、肾透析、肾移植后服抗排异药的门诊医疗费用,应由基本医疗保险统筹基金支付的,由指定的定点医疗机构填写《北京市医疗保险门、急诊(药店)费用审核结算凭证》,并持《北京市医疗保险特殊病种申报审批单》每月1日至20日内向参保人员参保的市和区、县医疗保险事务经办机构申请审核、结算。
第十六条 参保人员急诊抢救留观并收入住院治疗的,其住院前留观7日内,参保人员已现金支付的医疗费用应由基本医疗保险统筹基金支付的,由参保人员单位汇总,持缴费证明、参保人员定点医疗机构收入院证明,急诊处方底方及医疗费收据等有关资料,于参保人员出院后的次月1日至20日内到参保的市和区、县医疗保险事务经办机构申请审核、结算。
第十七条 参保人员在外埠的定点医疗机构就医发生的医疗费用,先由个人垫付,按规定应由本市基本医疗保险个人账户和统筹基金支付的医疗费用,由用人单位按月汇总,持外埠定点医疗机构的诊断证明、处方底方、费用清单和医疗费收据,填写《北京市医疗保险外埠就医费用申报明细表》,每月1日至20日内向参保的市和区、县医疗保险事务经办机构申请审核、结算。
第十八条 市和区、县医疗保险事务经办机构收到定点医疗机构或者用人单位医疗费用结算申请及有关材料后,在15个工作日内进行审核。对符合规定的医疗费用通知市和区、县社会保险基金管理机构予以支付。遇特殊情况需进一步调查的,可暂缓支付,但最长不得超过30个工作日。
用人单位收到社会保险基金管理机构支付的医疗费用后,应按支付数额及时发给参保人员。
第十九条 市和区、县医疗保险事务经办机构应加强对长期住院参保人员的管理,参保人员连续住院时间满6个月的,由定点医疗机构填写《北京市医疗保险住院超6个月登记审批表》,报市和区、县医疗保险事务经办机构备案。
第二十条 市和区、县医疗保险事务经办机构应加强对定点医疗机构门诊处方、急诊抢救留观、入出院标准、特殊检查治疗、住院病历的审核和管理。
第二十一条 区、县医疗保险事务经办机构应按月填报《北京市医疗保险门诊费用汇总表》、《北京市医疗保险特殊病种门诊费用汇总表》、《北京市医疗保险住院费用汇总表》,报市医疗保险事务经办机构,由市医疗保险经办机构进行汇总。
第二十二条 基本医疗保险费用结算应严格执行本市基本医疗保险管理的有关规定,对骗取基本医疗保险金,造成基本医疗保险基金损失的、有违法所得的,根据《北京市基本医疗保险规定》,由市和区、县医疗保险事务经办机构责令其退还、赔偿;市和区、县劳动和社会保障局进行处罚。
第二十三条 本办法由市劳动和社会保障局负责解释。
第二十四条 本办法自2001年4月1日起施行。

Ordinance may be cited as the Securities (Insider Dealing)
Ordinance.
nterpretation
In this Ordinance, unless the context otherwise requires--
